One of the truly fun things that too often comes up in a deposition is a witness who plays dumb, sometimes very dumb, to avoid answering a question. The following video is a good example; a witness perplexed (he claims) by the term photocopier:
"Sometimes the guidelines are conceptually hard to follow" is the understatement offered by U.S. District Judge Amul Thapar in a very unusual opinion granting a pro se defendant's request for an explanation as to why she was not eligible for a sentence reduction based on Amendment 782 to the U.S. Sentencing Guidelines that became effective November 1, 2014. No relief was granted or allowed, but Judge Thapar did offer a fair and earnest explanation, one whose effort deserves some plaudits. The case is United States v. Deborah Helton.
