The Sixth Circuit will hold its first round of oral arguments in 2014, the week of January 20-24. A total of 74 cases will be on the week's docket including appeals from various district courts, the Board of Immigration Appeals, the Benefits Review Board and the US Department of Agriculture. Further illustrating the death and disappearance of the federal civil jury trial the week's 74 cases do not include a single appeal from a civil jury trial. Two perhaps notable cases from the Eastern District of Kentucky are Rebecca Shupe v. Asplundh Tree Expert Company, No 13-5747 (plaintiff appeals summary judgment granted on claims of sex and age discrimination) and Megan Gilley v. Marcia Dunaway, et al, No 13-5933 (plaintiff appeals dismissal of complaint claiming violation of constitutional rights and other torts arising from plaintiff's alleged sexual abuse while a high school student).
The cases do include a total of 14 appeals of criminal jury trials by defendants. However, in only 8 of these appeals will oral argument before the Court be held; the other 6 are submitted on the briefs. Three judges, Judge R. Guy Cole, Jr., Senior Judge Eugene E. Siler, Jr., and Senior Judge Richard F. Suhrheinrich will each sit on three panels that will hear appeals from jury trials.
